Dively, Sherri: 2002
Sherri Dively was shot and killed by her husband of 24 years, Mickey Dively, on September 23, 2002.
It was the day after their anniversary, and the marriage was falling apart. Ms. Dively was preparing to leave her husband, an executive in Bedford at the Kennametal plant.
Two of Ms Dively’s friends, Marci Cameron and John Archdeacon, had come to help her pack. They were loading a van and a pickup truck with Ms Dively’s belongings when Dively came home from work. There was the confrontation outside the Claysburg home. Sherri Dively refused to stop packing her belongings, and Dively struck his wife, knocking her to the floor. He then shot her in the chest. The two friends ran for safety and were not injured.
Ms Dively was 44 years old at the time of her death. She was survived by an adult daughter living in Florida.
Dively was arrested by Greenwood Township police on September 23, 2002, and placed in Blair County prison, charged with criminal homicide, aggravated assault, and recklessly endangering other people.
Mickey Dively was defended by Thomas Dickey, a well-known Blair County attorney. Dickey portrayed Dively as a physically ill man, who suffered from heart problems and had had a kidney transplant. Dickey enlisted the aid of a ballistics expert and a pathologist. Dively stated that he “never meant to kill here. This whole thing seems like one big nightmare I can’t wake up from.” Testimony from witnesses were that on the day the murder was committed, Dively’s words were: “I have my gun cocked; I’ll shoot you.”
The verdict was reached in Judge Joleen Grubb-Kopriva’s courtroom on September 20, 2003. Although Dively was found not guilty of first degree murder; he was convicted of third degree murder, aggravated assault, and reckless endangerment. He was sentenced on December 17, 2003 to 20 to 40 years in prison. He filed an appeal to the Superior Court on January 27, 2004. This court affirmed the sentence on November 15, 2004. Mickey Allen Dively is currently in the Cresson State Correction Institution.
