Swanger, ?: 1881
James McGraw was tried for the murder of Mr. Swanger. McGraw threw a stone at Mr. Swanger. At McGraw’s trial, the defense tried to present evidence that he was insane, and provided numerous examples of his simplemindness. McGraw also made the claim that the stone had not killed Mr. Swanger; he believed that the doctor had addressed the injury with a hammer and chisel, causing the death. The bootblack-newspaper-seller was found guilty of second degree murder and sentenced to ten years in prison.
